“Not Legal Federally”
Marijuana Regulation and Taxation Act was signed into law by New York State, however it is still “Not Legal Federally”, so employees needing to do Federal Drug Testing & or/Drug Free Workplace requirements have to still comply with the specific requirements.
Cannot Use Marijuana
• The new law doesn’t prohibit Marijuana testing, but it is now illegal to discriminate against the legal use of Marijuana. Employers can be exposed for Marijuana discrimination.
• A positive test can still be of value to the employer
